Oct. 25, 2006 – While reportedly under investigation for her ties to an influential pro-Israel lobbying organization, California Rep. Jane Harman last month hosted a private dinner for the group that was attended by two top Bush administration officials—Director of National Intelligence John Negroponte and Secretary of Homeland Security Michael Chertoff.
The Sept. 13 dinner took place at the home of Harman, the ranking Democrat on the House Select Committee on Intelligence, and was attended by over 120 top financial backers of the American Israel Public Affairs Committee (AIPAC). The highlight of the evening was a panel discussion in which Harman played the host, questioning Negroponte and Chertoff about Mideast developments, international terrorism and homeland-security issues, according to an AIPAC official.
The dinner was hardly an unusual one for AIPAC. The group often arranges such elite pow-wows at the homes of senior members of Congress and government officials (one in the mid-1990s was hosted by then Vice President Al Gore) as a way for AIPAC to both demonstrate its political clout and to provide a perk for major donors.
But last month’s event raises new questions about recent reports that the FBI was investigating whether Harman, an outspoken supporter of Israel, last year may have agreed to improperly influence an ongoing Justice Department probe of AIPAC. The reports of the probe came just a few days after Harman released a politically sensitive House report that included important new details about the investigation surrounding the activities of disgraced former GOP Rep. Randy (Duke) Cunningham.
The low-level probe into Harman was launched last year after department officials received a tip that Harman was at the same time seeking the assistance of big AIPAC donors to lobby House Minority Leader Nancy Pelosi to stay on as the top Democrat on the Intelligence Committee (and become the panel’s chairman if the Democrats retake control of the House in next month’s elections.)

Casey, Jr., the commander of U.S.-led forces in Iraq, as he stood alongside Defense Secretary Donald Rumsfeld at a June 22 news conference. His confidence, he said, came from improvements in “the security situation and the progress of the Iraqi security forces.” Casey added, though, that he opposed setting a timetable for withdrawal of troops. “I feel it would limit my flexibility,” he said. “I think it would give the enemy a fixed timetable, and I think it would send a terrible signal to a new government of national unity in Iraq that’s trying to stand up and get its legs underneath it.”

Iran’s nuclear ambitions seen similar to Holocaust

JERUSALEM —Iran’s reported drive to make an atomic bomb has become an existential threat to Israel that some Israelis are likening to the Holocaust—especially with the United States appearing to back away from confrontation with Tehran.
The alarmists include Aharon Appelfeld, a leading Israeli author who as a child survived the Nazi killing of 6 million Jews.
“For the first time since I’m in the
country, I feel that we face a real existential danger,” Mr.
Appelfeld said.
The
memory of the Holocaust is a central element in Israel’s
collective
consciousness, a memory made more acute by Iranian President Mahmoud
Ahmadinejad’s denial that the Holocaust happened.
“It’s 1938,” said former Israeli Prime Minister Benjamin Netanyahu, “and Iran is Germany, racing to arm itself with atomic bombs.”
Addressing a Jewish audience in Los Angeles this month, Mr.
Netanyahu
added his voice to a growing sense of alarm in Israel about
Iran’s
seemingly inexorable march toward nuclear capability.
In his address, Mr. Netanyahu referred to Mr. Ahmadinejad’s repeated calls for wiping Israel off the map.
“Believe him and stop him,” Mr. Netanyahu said in the speech. “This is what we must do. Everything pales before it.”
Israel has half assumed, half hoped that if international pressure on Iran to halt its nuclear development fails, the United States would in the end use military force.
In recent weeks, however, a war-weary Washington seems to be backing away from a confrontation.

RIO DE JANEIRO, Brazil -- A swath of Amazon rain forest the size of Alabama was placed under government protection Monday in a region infamous for violent conflicts among loggers, ranchers and environmentalists.
Known as the Guayana Shield, the 57,915-square-mile area contains more than 25 percent of the world's remaining humid tropical forests and the largest remaining unpolluted fresh water reserves in the American tropics.
The protected areas will link to existing reserves to form a vast preservation corridor eventually stretching into neighboring Guyana, Suriname and French Guiana.
Conservation International put up $1 million to facilitate the expansion, which preserves much of the jungle's largely untouched north. Still, it's far from clear how much the new reserves will do to stall Amazon destruction, since most of the deforestation is taking place along the rain forest's southern border.

Analysis: High bar set in AIPAC
case

WASHINGTON, Nov. 30 (UPI)—The government has been set a high bar for conviction in the AIPAC secrets case—prosecutors must show the two lobbyists charged under espionage laws knew that the disclosure of the material they allegedly passed to reporters and Israeli officials would hurt the United States.
The defendants, Steven Rosen and Keith Weissman, lobbyists for the American-Israel Public Affairs Committee, or AIPAC, are charged with conspiring with Department of Defense intelligence analyst Larry Franklin to leak U.S. secrets in an apparent effort to influence U.S. policy towards Iran.
In a transcript of a recent pre-trial hearing, made available Tuesday, the judge in the case made it clear that prosecutors must prove intention, or what lawyers call “mens rea”—Latin for “a guilty mind”—for every element of the conspiracy.
“The Court imposed the requirement that the government prove that the defendant knew the information … would harm the United States,” Judge Thomas Ellis told the Nov. 16 hearing, though prosecutors had asked that this requirement be lifted.
That is important, explains government transparency advocate Steven Aftergood of the Federation of American Scientists, because it means the defendants, if found guilty, will have been proved to have “the intention of hurting the United States.”
“That distinguishes the activities with which they are charged from the routine activities of reporters and advocates,” Aftergood told United Press International, “who may made trade in classified information,” but don’t so with the intention of harming U.S. security.
He called the bar set by the ruling “a considerable, possibly insurmountable obstacle” to the government.

Iraq is not a prize to be won or lost. It is part of the ongoing global struggle against instability, brutality, intolerance, extremism and terrorism. There will be no military victory or military solution for Iraq. Former secretary of state Henry Kissinger made this point last weekend.

With major lobbying and ethics reform proposals on the congressional fast track, a number of Jewish groups are working furiously to shape a reform package that deals with the real abuses that have taken place in recent years without cutting into their legitimate advocacy efforts � especially sponsored congressional travel.
The problem is especially acute for AIPAC, the pro-Israel lobby, which has a nonprofit educational foundation that brings lawmakers, staffs and other politicians to Israel, and United Jewish Communities (UJC), which represents numerous Jewish federations and community relations councils, which sponsor both foreign and domestic fact-finding travel

Global Warming Goes to Court
The Bush administration has been on a six-year campaign to expand its powers, often beyond what the Constitution allows. So it is odd to hear it claim that it lacks the power to slow global warming by limiting the emission of harmful gases. But that is just what it will argue to the Supreme Court tomorrow, in what may be the most important environmental case in many years.
A group of 12 states, including New York and Massachusetts, is suing the Environmental Protection Agency for failing to properly do its job. These states, backed by environmental groups and scientists, say that the Clean Air Act requires the E.P.A. to impose limits on carbon dioxide and other greenhouse gases emitted by new cars. These gases are a major contributor to the “greenhouse effect” that is dangerously heating up the planet.
The Bush administration insists that the E.P.A. does not have the power to limit these gases. It argues that they are not “air pollutants” under the Clean Air Act. Alternatively, it contends that the court should dismiss the case because the states do not have “standing,” since they cannot show that they will be specifically harmed by the agency’s failure to regulate greenhouse gases.
A plain reading of the Clean Air Act shows that the states are right. The act says that the E.P.A. “shall” set standards for “any air pollutant” that in its judgment causes or contributes to air pollution that “may reasonably be anticipated to endanger public health or welfare.” The word “welfare,” the law says, includes “climate” and “weather.” The E.P.A. makes an array of specious arguments about why the act does not mean what it expressly says. But it has no right to refuse to do what Congress said it “shall” do.

of Iraq and the overthrow of Saddam Hussein. Like many in Washington,
Wurmser “believes that, so far, there’s been no
price tag on Iran for
its nuclearefforts and for its continuing agitation and intervention
inside Iraq,” the consultant said. But, unlike those in the
Administration who are calling for limited strikes, Wurmser and others
in Cheney’s office “want to end the
regime,” the consultant said. “They
argue that there can be no settlement of the Iraq war without regime
change in Iran.”...
The Bush Administration, if it does take military action
against Iran,
would have support from Democrats as well as Republicans. Senators
Hillary Clinton, of New York, and Evan Bayh, of Indiana, who are
potential Democratic Presidential candidates, have warned that Iran
cannot be permitted to build a bomb and that—as Clinton said
earlier
this year—“we cannot take any option off the
table.” Howard Dean, the
chairman of the Democratic National Committee, has also endorsed this
view.

The Sabra and Shatila plaintiffs’ case was inspired, in large part, by the “Pinochet Principle,” so-named because of a Spanish court’s attempt to extradict General Augusto Pinochet from the United Kingdom to stand trial in Madrid under the principle of universal jurisdiction for crimes committed in Chile a quarter of a century earlier.
That endeavor sparked attempts by Chileans to pursue justice in Chile, and led to increasing attention to, and legal action against, Gen. Pinochet in his own country.
Sadly, attempts to try Israeli war criminals in national courts outside of Israel have not had similar encouraging reverberations within Israel. Israeli citizens could do much more to challenge the impunity of their political and military leaders. Universal jurisdiction should not be the only option or the first choice for prosecuting grave violations of international law. It remains the duty and responsibility of the fellow citizens of war criminals to bring them to the bar of justice within their own court system. Failing that, efforts to pursue justice through the use of universal jurisdiction and the International Criminal Court remain relevant and crucial.

Former dictator Gen. Augusto Pinochet was indicted Monday and ordered to remain under house arrest for the execution of two bodyguards of Salvador Allende, the freely elected Marxist president who was toppled in a 1973 coup.
The indictment came after Pinochet’s 91st birthday Saturday, which he marked by issuing a statement for the first time taking full political responsibility for abuses committed by his regime.
Monday’s indictment was the fifth time Pinochet has been put under house arrest on charges stemming from human rights violations during his 1973-90 dictatorship. The document was issued by Judge Victor Montiglio, the Supreme Court press office said.
Pinochet was stripped of his immunity from prosecution in the case last July.
The indictment alleges kidnapping and homicide in connection with the deaths of two Allende bodyguards—Wagner Salinas and Francisco Lara—who were arrested the day of the coup, Sept. 11, 1973. Both were executed by firing squad four weeks later, the military regime announced at the time. Salinas was a former South American heavyweight boxing champion.
More than 15 of Allende’s bodyguards and aides were taken from the government palace during the coup and remain unaccounted for. Allende committed suicide during the military’s bombardment of the palace.
There was no immediate reaction from Pinochet’s lawyers, but they are expected to appeal the indictment to the Supreme Court, as they have in earlier cases.
Two of those cases were closed when the courts ruled Pinochet’s health prevented him from standing trial. In addition to Monday’s indictment, three others are pending, two alleging human rights violations and a third charging tax evasion.
Pinochet has been diagnosed with a mild dementia caused by several strokes. He also suffers from diabetes and arthritis and needs a pacemaker.
On Saturday, Pinochet issued a statement taking political—though not explicitly legal—responsibility for the actions of his regime.
“Today, near the end of my days, I want to say that I harbor no rancor against anybody, that I love my fatherland above all and that I take political responsibility for everything that was done which had no other goal than making Chile greater and avoiding its disintegration,” he said.
Scores of other legal actions have been filed against Pinochet by relatives of victims of his regime. During his rule, 3,197 people were killed for political reasons, according to an independent commission report.
